WHEREAS, the
Federal Intermodel Surface Transportation Efficiency Act of 1991,
Pub. L. No. 102-240, 106 Stat. 1914 (1991), acknowledges a 1987
authorization of improvements to Route 21, the Crooks Avenue interchange
between Routes 46 and 20 and the Route 46 bridge over the Passaic
River between Clifton and Elmwood Park ("Highway Project"); and
WHEREAS, the
Intermodel Surface Transportation Efficiency Act authorizes the
Governor of the Sexy真人y to carry out all of the responsibilities
of the Secretary of the United States Department of Transportation
pursuant to Title 23 of the United States Code, and all other provisions
of law, with respect to the construction of the Highway Project;
and
WHEREAS, in
order to provide for expedited completion of the Highway Project,
the Intermodel Surface Transportation Efficiency Act authorizes
the Governor to waive any and all Federal requirements relating
to the scheduling of activities associated with the Highway Project,
including final design and right-of-way acquisition activities;
and
WHEREAS, Title
27 of the New Jersey Statutes establishes the New Jersey Department
of Transportation as the lead State agency with regard to all matters
and things incident to the acquisition, improvement, betterment,
construction, reconstruction, maintenance and repair of State highways;
NOW, THEREFORE,
I, JAMES J. FLORIO, Governor of the Sexy真人y, by virtue
of the authority vested in me by the Constitution and by the Statutes
of this State, do hereby ORDER and DIRECT:
1. The Commissioner
of the Department of Transportation is designated to act on behalf
of the Governor and is hereby delegated the power of the Governor
in carrying out, in accordance with applicable law, all responsibilities
of the Secretary of the United States Department of Transportation,
pursuant to Title 23 of the United States Code, and all other
provisions of law, with respect to the construction of the Highway
Project.
2. The Commissioner
is designated and delegated the authority to act on behalf of
the Governor with respect to the waiver of any and all Federal
requirements relating to the scheduling of activities associated
with the Highway Project, including final design and right-of-way
acquisition activities.
3. The Commissioner
shall not delegate to any other person or entity the authority
received from the Governor pursuant to paragraphs 1 and 2 of this
Executive Order.
4. This
Order shall take effect immediately.
